13. Dispute Resolution and Arbitration
13.1 Informal Resolution

We will use good faith efforts to resolve any dispute within thirty (30) days of receiving your written notice describing the nature and basis of the claim and the relief sought.
13.2 Binding Arbitration
If informal resolution is unsuccessful, and except as expressly provided below, you and Mod Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of our services, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org.
The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. This agreement to arbitrate shall survive the termination of these Terms.
13.3 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MOD PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
13.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Additionally, claims that fall within the jurisdiction of small claims courts may be brought in such courts, provided the dispute qualifies and remains in such court on an individual basis.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you use or access our Site or services. We reserve the right, in our sole discretion and without prior notice, to:

In such events, our obligations will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume performance as soon as practicable.
